Erskine & McMahon Wins $2,000,000 Verdict
A few months ago, Blake Erskine, Mark McMahon and co-counsel Dan Stroup tried an automobile collision for
their clients (the Hughes) from Daingerfield, Texas, who were hit “head-on” by a FedEx Ground Package truck
in Ore City, Texas. In December 2006, Mr. and Mrs. Hughes were traveling from Longview back to their
home in Daingerfield. While Mrs. Hughes was driving her husband to their home, traveling north on Highway
259 in Ore City, Texas, a FedEx truck suddenly ran a red light and turned left in front of the Hughes vehicle
(who had the green light), causing the Hughes vehicle to run directly into the FedEx truck. Mr. Hughes
sustained a “burst” fracture to his mid-back – essentially a completely broken back – which required immediate
surgery. The jury heard evidence about his prior surgery from his physician, Dr. Jonathan Fontenot of
the Diagnostic Clinic of Longview, Texas, as well as testimony regarding a future back fusion which he will
ultimately need. In addition, Mr. Hughes owned a wrecker service in Daingerfield at the time of the
collision, which he was forced to sell due to his severe injuries and disabilities as a result of the wreck.
The jury heard all of the evidence and found in favor of Mr. Hughes with a verdict in excess of $2,000,000.00 to
the benefit of Mr. Hughes.
